This is an update to a story that I posted about a week or so ago. The article talked about the then 75-year old killing his unarmed 13-year old neighbor. Thirteen year old Darius Simmons was accused by the older man of stealing his 4 guns from his home. The older man, whose name I refuse to type, killed the unarmed teen in broad daylight. The older man has now been convicted and will spend the rest of his life in jail. Read the story below.

He won’t ever see the light of day as a free man again.

That’s the decision a judge handed down Monday against John Henry Spooner, the Milwaukee man who gunned down his 13-year-old neighbor after accusing the teen of robbery. The blatant broad-daylight killing of Darius Simmons, ironically, was all caught on Spooner’s own surveillance camera system, which gave prosecutors indisputable evidence.

“There should never be any light in the tunnel for you,” Judge Jeffrey A. Wagner said in court, the Milwaukee Journal-Sentinel reported. “This is one of the worst of the worst.”
There’s little light left anyway for the 76-year-old murderer, who has lung cancer and heart disease and suffers from frequent bouts of pneumonia. Spooner’s grim health prospects may have played a part in his callous disregard for human life on May 31, 2012, when he gunned down Simmons on the sidewalk as the boy brought in a garbage can. Spooner fired two shots at the teen after accusing him of stealing four shotguns from his home two days prior. One of the shots hit the boy in the chest, killing him. A second shot missed and a third trigger pull ended in a misfire.

Patricia Larry, holding a photograph of her slain son, Darius Simmons, said she will pray for the man who took his life.

A police search of Simmons’ home did not recover the missing weapons, which were valued at thousands of dollars.

The crotchety killer, who was convicted of first-degree murder, showed no remorse for what he did when he took the stand Monday, a decision derided by his own attorney. Spooner blamed Simmons’ mother, Patricia Larry, for the alleged theft, saying she made the boy steal the guns. The old man, who’d been robbed prior, had no evidence the boy entered his home other than grainy surveillance video that showed a black suspect.

Some speculated immediately after the shooting that it may have been racially motivated, but Spooner, who is white, never mentioned race during the trial. Prosecutors, too, never contended the shooting was a hate crime.

“I feel sorry for Darius,” Spooner said from the stand. “He had nobody who loved him enough to teach him to go straight.”

The broad-daylight killing was captured on Spooner’s own surveillance system. Spooner had accused the teen of stealing shotguns from his home before he fired a fatal bullet into his chest.

That didn’t stop Spooner from killing the unarmed teen in cold blood. And, incredibly, Larry said she would pray for the man, for whom she has no hate.

“He is a menace to society,” Larry said. “No mother should have to go through this.”

Wagner, in handing down the maximum sentence, agreed with the grieving mother.

“It was an evil act,” Wagner said. “That family is left without the love of their child. (Simmons) will never be able to experience childhood, to go through high school … to go to college, to get married, to have children. You took that all away from him.”
